50/50 Raffle Rules

NO CONTRIBUTION OR PURCHASE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED.

Introduction

The 50/50 Raffle (“Raffle”) is sponsored by OurSeniors.org, Inc., a Section 501(c)(3) not for profit corporation whose principal place of business is PO Box 730956 Ormond Beach, Fl 32173 (“Sponsor”). 

Eligibility

The Raffle is open to all persons who, at the time of entry, are at least eighteen (18) years of age and are present at any of our events Identified Events https://ourseniors.net/news-events/upcoming-events/ (the “Raffle Area” and such facility, the “Facility”). Sponsor has the right to request photo identification from any person desiring to enter the Raffle. The Raffle is void where prohibited by law, rule, or regulation. All federal, state and local laws and regulations apply.

Raffle Period

Each Raffle will have start dates and times based on Eastern Standard Time (“EST”) and ending dates and times  (“End Date”) based on (“EST). The Raffles can take place online and or live at our events. The Facility location will also be identified prior to take place at the Facility on the End Date (“Raffle Period”). 

Method of Entry

During the Raffle Period, eligible persons may enter only by obtaining an official ticket (each a “Ticket”), each of which shall bear a unique identification number (each a “Ticket Number”) to be used to determine the winner of the Prize (defined below). An eligible person may obtain a free Ticket by (a) submitting the online entry form found here during the Raffle Period or (b) by mailing a 4” x 6” card to OurSeniors.org, Inc., PO Box 730956, Ormond Beach, Fl 32173 requesting such Ticket.  Any eligible person may only obtain one (1) free Ticket during the Raffle Period, but any eligible person may, in his/her discretion, purchase additional Tickets beyond his/her initial, free Ticket during the Raffle Period (a) at https://www.ourseniors.org/5050raffles/ or (b) from a representative of Sponsor at any OurSeniors.org, Inc. events Facility during the Raffle Period. Each Ticket an eligible person obtains during the Raffle Period constitutes one (1) entry into the Raffle and obtaining a Ticket during the Raffle Period constitutes full and unconditional agreement to and acceptance of these Official Rules by an eligible person. All 50-50 Raffle tickets that are purchased online or in person are final, and no refunds will be issued.

For the avoidance of doubt, online entry is void if such entry is submitted by a person who is outside of the Raffle Area and/or where prohibited by law, rule or regulation.

A list of scheduled Raffles to take place at any Facility and or address during the Raffle Period is available at www.ourseniors.org/5050raffles/ or by telephone at (800) 647-0868 during the Sponsor’s regular business hours, though dates and start times are subject to change due to Holidays. There could be some Events that will not have 50/50 Raffles at the Facilities during the Raffle Period is cancelled or postponed, such Event will not be a part of the Raffle. 

DATA CHARGES MAY APPLY TO USE OF MOBILE PHONE/DEVICE TO PARTICIPATE IN THE RAFFLE.

Prize and Odds:

During the specified time to take place at the Facility on the End Date, Sponsor shall conduct a random drawing at the Facility (“Drawing”) of all eligible entries received during the Raffle Period to win one (1) check in the amount of fifty-percent (50%) of the Net Raffle Proceeds (defined below), which is the  (“Prize”).

Odds of winning the Prize depend on the total number of eligible entries received during the Raffle Period. The holder of the Winning Ticket Number (defined below) is the “Winner.”

The Prize shall be paid to the Winner via check from Sponsor and shall not be paid to any other person on behalf of such Winner. The Prize will only be awarded and delivered to addresses within the Raffle Area. Except as determined by the Sponsor in its sole discretion, no substitution of the Prize is offered, and no transfer or assignment of the Prize to a third party is permitted. Any and all taxes, fees, and other costs including but not limited to federal and, if applicable, state and local income and withholding taxes that may arise and be due or asserted on the value of the Prize are the sole responsibility of the Winner. All other expenses on the receipt and use of the Prize not specifically mentioned herein are solely the responsibility of the Winner. In no event will Sponsor be liable to award more than the number of Prizes stated in these Official Rules. “Net Raffle Proceeds” means the total proceeds from all Ticket(s) obtained by all eligible persons in addition to those initial, free Tickets offered to all eligible persons via one of the methods identified above (“Total Proceeds”) less a maximum of ten-percent of the Total Proceeds (which Sponsor shall retain to cover applicable administrative fees and equipment-related costs). Sponsor is required by law to withhold and remit to the Internal Revenue Service (“IRS”) on behalf of the Winner who wins the Prize to be awarded via the Drawing the amount equal to twenty-four percent (24%) of the Prize (“Withholding Amount”), if the Prize is greater than $5,000 and if such Winner is a citizen or resident alien of the United States with a social security number (different rules, as promulgated by the IRS, apply citizens and resident aliens of the United States who do not have a social security number for nonresident aliens). 

 Notification

Within a commercially reasonable period of time following the Drawing, Sponsor shall publish the Ticket Number corresponding to the winning eligible entry drawn by Sponsor in the Drawing (the “Winning Ticket Number”) at https://ourseniors.org/5050raffle/winners  and OurSeniors Mobile App and The Winning Ticket Number may also be obtained by calling (800) 647-0868 during Sponsor’s normal business hours and asking for a representative of the OurSeniors.org, Inc. 

Sponsor shall send the Winner an e-mail to the e-mail address supplied on entry or call the Winner at the phone number supplied on entry within a commercially reasonable period of time following publication of the applicable Winning Ticket Number. The winner shall also be responsible for contacting Sponsor, once the winning ticket number has been announced and published online within seven (7) business days, if not forfeit the Prize. Via such e-mail or phone call, Sponsor will notify the Winner that he/she is the Winner of the Prize and communicate instructions to claim the Prize. Each entrant is responsible for monitoring his/her e-mail or phone number supplied on entry for such notification, instructions and any other communications related to this Raffle and may also contact Sponsor by sending an e-mail to info@ourseniors.org. If the Winner cannot be reached by the Sponsor within seven (7) business days or if the Prize is returned as undeliverable and/or goes unclaimed, the Winner shall forfeit the Prize. Upon the request of the Sponsor, Winner (or, if applicable, alternate winner) may be required to return an Affidavit of Eligibility, Release and Prize Acceptance Form, IRS W-9 form (and/or other applicable IRS forms), a liability release, and (where legal) a publicity release, all of which must be returned within the time period specified within such materials. Should the Winner (or, if applicable, alternate winner) fail to comply with any such requirements, the Winner (or, if applicable, alternate winner) may be disqualified by Sponsor, in Sponsor’s sole discretion, and Sponsor may then select an (or, if applicable, another) alternate winner.

Personally Identifiable Information and Publicity Release

Personally identifiable information supplied by entrants upon entry into the Raffle shall be used by Sponsor solely to administer the Raffle, unless otherwise expressly provided in these Official Rules or unless any such entrant actively opts-in to receipt of other communications from Sponsor.

The Winner agrees that acceptance of the Prize grants to Sponsor the right to print, publish, broadcast, and use world-wide, in any media now known or later developed at any time or times, the Winner’s name, portrait, picture, voice, likeness, and biographical information for any purpose, including but not limited to in advertisements, publicity, and other communications without additional compensation, except where prohibited by law.

Release

BY ENTERING THE RAFFLE, ALL ENTRANTS, INCLUDING THE WINNER, AGREE TO RELEASE, DISCHARGE AND HOLD HARMLESS SPONSOR, OURSENIORS.ORG, INC., OPERATION SUPPORT OURSENIORS.ORG, OURSENIORS.NET MAGAZINE, LLC, AXIOM ADMINISTRATIVE SERVICES, LLC, AXIOM INTEGRATED SERVICES, LLC., ANY AND ALL OF THE GUEST SPEAKERS PRESENTING AT THE LUNCH AND LEARN EVENTS, APPROVED VENDORS IN ATTENDANCE, FACILITIES, AND OR RESTAURANTS, ALL OF THEIR RESPECTIVE CURRENT AND FUTURE AFFILIATES AND RELATED ENTITIES, AND EACH OF THEIR RESPECTIVE SUCCESSORS, OWNERS, GENERAL AND LIMITED PARTNERS, SHAREHOLDERS, MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES AND AGENTS (“RELEASED PARTIES”), FROM ANY AND ALL LIABILITY FOR ANY INJURY, LOSS, OR DAMAGE OF ANY KIND WHETHER DIRECT OR INDIRECT, WHICH MAY BE DUE TO, OR ARISE OUT OF, (I) PARTICIPATION IN THE RAFFLE, (II) THE ACCEPTANCE, USE, MISUSE, NON-USE, OR POSSESSION OF THE PRIZE, (III) PREPARING FOR, PARTICIPATING IN AND/OR TRAVELING TO OR FROM ANY PRIZE-RELATED ACTIVITY, INCLUDING ANY GAME, (IV) CLAIMS BASED ON RIGHTS OF PUBLICITY, RIGHTS OF PRIVACY, AND/OR DEFAMATION AND (V) PRIZE DELIVERY. All causes of action arising out of or connected with the Raffle or the Prize awarded shall be resolved individually, without resort to any form of class action. All claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees and costs.

Disclaimer

Released Parties are not responsible for any errors which may occur in connection with the administration of the Raffle, the processing of entries, any actions to be taken by any of them pursuant to the section entitled “Notification” above, any other announcements or telephone or in-person conversations relating to the Raffle or in any Raffle-related materials. To the extent permissible by applicable law, Sponsor reserves the right, in its sole discretion, to terminate, modify, or suspend the Raffle should Sponsor determine, in its sole discretion, that any virus, bug, non-authorized human intervention or other causes have corrupted or affected the administration, security, fairness or proper conduct of the Raffle. In such case, Sponsor will select the winning eligible entry from a random drawing of all eligible entries received prior to the aforesaid action taken by Sponsor. Released Parties are not responsible for, and Sponsor reserves the right to correct, typographical, clerical or printing errors in any Raffle-related materials, including these Official Rules. Released Parties are not responsible or liable for any events beyond the control of Sponsor which may cause the Raffle to be stopped, including but not limited to any error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction or unauthorized access to, or alteration of, entries, nor are the Released Parties responsible for any failure of any Ticket to be delivered on account of technical problems or human error, or any combination thereof. Sponsor may, to the extent permissible by applicable law, exclude, disqualify or terminate participation in the Raffle to any entrant who, in Sponsor’s sole discretion: (a) ignores these Official Rules; (b) acts in a manner Sponsor determines to be not fair; (c) acts with an intent to annoy, threaten or harass any other entrant or the Sponsor; (d) acts in any other disruptive manner; or (e) tampers with the entry process. Sponsor will not replace any lost, mutilated, or stolen Tickets. Sponsor reserves the right to make changes in these Official Rules, which changes will become effective upon publication of the revised version of these Official Rules at https://www.ourseniors.org/5050rafflerules.

Caution

ANY ACT OR ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THE RAFFLE OR UNDERMINE THE LEGITIMATE OPERATION OF ANY RAFFLE MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY INDIVIDUAL(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. ALL OF THIS INFORMATION IS COPYRIGHTED TO OURSENIORS.ORG, INC.

Choice of Law/Jurisdiction

Except where prohibited by law, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants, the potential winners and Sponsor in connection with the Raffle, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Florida or any other jurisdiction) that might otherwise cause the application of the laws of any jurisdiction other than the State of Florida. Any action seeking legal or equitable relief arising out of or relating to any Raffle or these Official Rules shall be brought only in the courts of the State of Florida located in Volusia County.

Identity of Winners

For the name of the Winner, send a self-addressed stamped envelope within sixty (60) days of the Drawing to OurSeniors.org, Inc., PO Box 730956, Ormond Beach, FL 32173 and identify the Drawing for which the name of the Winner is to be provided.

Sponsor

A COPY OF SPONSOR’S OFFICIAL REGISTRATION AND FINANCIAL INFORMATION MAY BE OBTAINED FROM THE DIVISION OF CONSUMER SERVICES BY CALLING TOLL-FREE WITHIN THE STATE 1-800-HELP-FLA (435-7352).
